Or was he purely relying on what the off-duty guy saw? If so, seems it would be pretty easy to fight in court. First, the cop who actually saw the violation won't be there. Second, the cop who wrote the ticket will either lie, or have to admit that he didn't see what happened. Sounds like you have a case, it's worth the money to get a decent lawyer and make sure you have a clean record when all is said and done because otherwise insurance will screw you for a long, long time (which will cost much more than a lawyer right now will). By the way, I saw an undercover cop that was a white Mustang in Chicago this weekend. No markings, no nothing and dark, dark, tinted windows. It was an evil beast I tell ya. I also saw an uncover car that was an Impala. And here I've trained myself to look for Crown Vic's and the like...
